Job Duties
This position works as part of a Shared Services Team serving both the Virginia Employment Commission and Virginia Works.
Manages Employee Relations (ER) Unit activities in a shared services environment; serves multiple agencies as the SME and liaison on ER, Equal Opportunity (EO) and Equal Employment Opportunity (EEO), employment law, mediation, and conflict resolution activities; handles administrative duties and supervises staff; drafts and implements policies/procedures; conducts training; and serves as a member of the HRMS senior team.
Manages and coordinates progressive discipline, grievance procedure process, mediation, workplace investigations, ADA accommodations, and discrimination complaints.
Provides technical assistance and guidance; consults with managers, supervisors, employees, and external parties to impart information and effectively resolve issues; and renders advice on complex, sensitive or unprecedented human resource policies and procedural issues.
Conducts investigations related to complaints from or about employees and customers; represents shared services agencies in court, mediation, and/or grievance proceedings; and makes legally defensible recommendations to the HR Director and Commissioner(s).
Responds to inquiries received from various entities (e.g., EEOC, DHRM, DOL, and CRC), handles complaints from employees or customers who have participated in shared services programs, activities or services; and handles complaints related to Civility in the Workplace and Workplace Violence.
Manages the disciplinary process, grievance procedure and mediation programs. Reviews/approves requests for reasonable accommodation (RA); tracks and maintains documentation; and works with various parties to ensure RAs are provided.
Minimum Qualifications
Extensive knowledge of HR principles/practices; ER/EEO/EO programs/policies/procedures (disciplinary actions/due process/ mediation/grievance/investigations); and related requirements (ADA/ADEA/Civil Rights Act of 1964 and amendments).
Strong facilitation, negotiation, leadership, oral/written communication, and computer (e.g., MS Office Suite) skills.
Demonstrated ability to administer related ER/EEO/EO programs; provide technical assistance and respond to inquiries; conduct investigations, document findings and recommend solutions, and serve as representative in court, medication, and/or grievance proceedings; interpret and apply laws, policies and procedures; ensure compliance and actions are legally defensible; develop and implement policies and procedures; and manage programs and staff.
Valid driver's license as overnight travel may be required occasionally to meet with various parties.
Additional Considerations
Experience, education, and/or training in human resources, employee relations, employment law, conflict resolution.
Progressively responsible experience managing ER, EEO, and/or EO functions.
Experience managing and/or coordinating an employee relations program.
Experience working with the Commonwealth's Grievance Process and Mediation program.
Human Resource related certification (e.g., Mediator, SHRM, and/or HRCI).
