Hiring Agency Education & Labor Cabinet | Department of Education Location 300 Sower Boulevard Frankfort, KY 40601 USA Description The Kentucky Department of Education is a premier service agency of the Commonwealth of Kentucky. The department provides resources and guidance to Kentucky's public schools and districts as they implement the state's K-12 education requirements. The department also serves as the state liaison for federal education requirements and funding opportunities. The department seeks to hire a smart, experienced, hardworking and dependable Staff Attorney I to join our dedicated team. Key Responsibilities: * Provides routine legal services of a varied nature which are typically characterized by facts that are well established, involve established legal precedents and have a relatively moderate impact. * Provides legal advice and representation to the Division of School and Community Nutrition for all programs administered by the Division, including but not limited to: Child and Adult Care Food Program, National School Lunch Program, School Breakfast Program, Afterschool Snack Program, Fresh Fruit and Vegetable Program, Seamless Summer Option, Special Milk Program, and Summer Food Service Program. Reviews and provides legal advice on federal and state administrative regulations implementing the programs administered by the Division of School and Community Nutrition. Represents the agency in administrative hearings and judicial review initiated pursuant to programs administered by the Division of School and Community Nutrition. * Conducts research and provide legal advice regarding the applicability of the Kentucky Open Records Act and Kentucky Open Meetings Act, including applicable exceptions, to agency operations. Represents the agency by responding to requests for public records under the Kentucky Open Records Act. Represents the agency in actions filed challenging the agency's compliance with the Kentucky Open Records Act and Open Meetings Act. * Provides legal advice to the agency, including investigators and the Testing Board of Review, regarding allegations of violation of 703 KAR 5:080, Administration Code for Kentucky's Educational Assessment Program, and 703 KAR 5:070, Procedures for the Inclusion of Special Populations in the State-Required Assessment and Accountability Programs. Conducts investigations and draft written findings for alleged violation of 703 KAR 5:080, Administration Code for Kentucky's Educational Assessment Program, and 703 KAR 5:070, Procedures for the Inclusion of Special Populations in the State-Required Assessment and Accountability Programs. * Conducts, reviews, researches, negotiates and provides legal advice to the agency regarding routine contracts to which the agency will be or is a party. This includes, but is not limited to, review for compliance with the Kentucky Constitution, applicable statutes and regulations, policies of the Finance and Administration Cabinet, and agency policies. * Conducts research and provides responses on behalf of the agency to constituent inquiries pursuant to KRS 156.240 requiring the Commissioner of Education to explain the true intent and meaning of the school laws and the published administrative regulations of the Kentucky Board of Education. * Handles various phases of litigation with immediate supervision. Performs legal research, prepares briefs, and drafts opinions. Prepares and argues cases. Carries out simple and/or routine negotiations with clients, witnesses, or other interested parties in gathering information. Provides representation and other services in state and federal courts and administrative forums. May work as a member of an inter-disciplinary team and may coordinate the efforts of non-attorney staff. Assists in drafting legislation and administrative regulations. * Performs other duties as assigned. EXPERIENCE, TRAINING, OR SKILLS: NONE Substitute EDUCATION for EXPERIENCE: NONE Substitute EXPERIENCE for EDUCATION: NONE SPECIAL REQUIREMENTS (AGE, LICENSURE, REGULATION, ETC.): Must be admitted to practice law and in good standing in the Commonwealth of Kentucky OR comply with Kentucky Supreme Court Rule (SCR) 2.111 (limited certification of admission to practice), SCR 2.112 (attorney participants in defender or legal services programs), SCR 2.116 (supervised practice), or SCR 2.117 (practice pending admission). Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this job classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s) or other credentials. Working Conditions Duties are performed primarily in both office and courtroom settings. Travel is required.
