The Agency is responsible for the oversight and administration of the Florida Medicaid program, the licensure and regulation of nearly 50,000 health care facilities and empowering consumers through health care transparency initiatives. The Work You Will Do: Review, analyze and process requests for hearing in accordance with Section 120.569(2)(c), Florida Statutes. Issue Orders of Dismissal without Prejudice where necessary. Receive and process all petitions for waivers and variances and petitions for declaratory statements; monitor the statutory deadlines for such petitions to ensure that decisions on such petitions are timely issued. Receive recommended orders from informal hearing officers and administrative law judges, rule on exceptions and draft proposed final orders for review by the General Counsel. Review and analyze responses to Orders of Dismissal without Prejudice and draft proposed final orders dismissing deficient hearing requests. Receive and rule on administrative motions, including motions to dismiss; motions for abeyance; motions for extension of time; and motions to stay agency action. Review all final orders issued by the Agency for proper form and substance. Ensure that copies of the final orders are sent to all parties in a timely manner. Ensure all final orders are timely and correctly scanned into the Laserfiche electronic final order database. Review every scanned final order to ensure the original final order was correctly scanned into Laserfiche, that the Laserfiche final order template contains the correct information, and that the final order was sent to the appropriate file. Once the Agency's final orders are available online, serve as the Agency's contact with regard to assisting Agency employees and outside parties with questions or concerns regarding viewing Agency final orders via the internet. Serve as custodian for all final orders issued by the Agency. Chief Ethics Officer for the Agency. Assemble, certify, and transmit the record of an administrative proceeding when a final order is appealed to a District Court of Appeal. Upon receipt of a notice of appeal in a fair hearing case, contact the Director of Appeal Hearings at the Department of Children and Families to obtain a copy of the record of the case. Archive records of cases received by the Agency Clerk's Office 60 days after the final order has been issued or, in cases where an appeal was filed, 60 days after the appeal was dismissed or the mandate was issued, unless further Agency action is required. Supervise the work of the OPS Staff which is assigned to assist the Office of the Agency Clerk. Supervise the Administrative Assistant II staff, including approving their leave and timesheets, as well as completing performance appraisals on them. Perform legal research on specific legal issues at the request of the General Counsel or Deputy General Counsel. Assist members of the public with questions regarding the filing of petitions and operations of the Agency Clerk's Office. Perform other duties as specified by the General Counsel or Deputy General Counsel. Alternate HIPAA Privacy Officer Oversees ADA and Civil Rights Compliance Officer with respect to complaints. Oversees Public Records Unit and provides counsel on public records issues. MINIMUM QUALIFICATIONS REQUIREMENTS Attorney in good standing with the Florida Bar. Minimum of two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.
