Division Overview: Montana's Division of Criminal Investigation is a diverse public safety team of professionals who provide a full range of criminal investigative services to state, local, and tribal law enforcement. Job Overview: This Medicaid Fraud Lawyer position is responsible for handling all issues associated with advising the Medicaid Fraud Control Unit within the Bureau and prosecuting the cases related to Medicaid provider fraud and elder and patient neglect, abuse, and exploitation. The incumbent is responsible for independently handling all phases of simple and complex criminal prosecutions and related civil cases in justice courts, district courts, and the Montana Supreme Court. This requires factual assessment of the case, legal research and writing, preparation of legal documents, and oral presentation of testimony and argument. The incumbent will work with a team of attorneys on issues of training and legal review. Assigned Duties: Represents the State of Montana in simple and complex criminal prosecutions in justice courts, district courts, and the Montana Supreme court. "Complex" cases include cases that have numerous defendants, numerous crimes, complicated fraud issues, complex forensic evidence, complex medical evidence, and/or novel legal issues. Cases may be high profile cases. Work includes working with other attorneys in the Attorney General's Office and local prosecutors. Evaluation of investigation for civil prosecution. Cases that cannot be prosecuted criminally may lend themselves to civil prosecution. If so, the attorney will perform all those tasks necessary to present the claim of the State as a civil case. Acts as advisor to Medicaid Fraud Control Unit of DOJ and Montana Department of Public Health and Human Services (DPHHS) regarding fraud and elder and patient neglect, abuse, and exploitation issues. Prepares training materials for presentation and distribution regarding the practice of criminal law in Montana and regarding provider fraud and elder and patient neglect, abuse, and exploitation specifically. Conducts or assists with training of law enforcement, prosecutors, and/or agency attorneys or staff regarding such topics. Qui Tam Cases: Monitors qui tam cases that name Montana as a plaintiff which contain allegations of false claims to our Medicaid agency. Global Cases: Report to the Attorney General with recommendations when settlements are proposed. Minimum Qualifications: * Juris Doctor Degree. * At least two years of specialized law and litigation experience. * Admission to and maintenance of licensure from the State Bar of Montana. * If licensed in another state, must be able to become licensed to practice law in Montana within one year of hire. Individuals with 5 years of practice in another state in good standing are eligible to be admitted on motion.
